Terms of Service

These terms govern your use of ProjectDigo (the "Service"), provided by Richard Gyor, established in the Netherlands at Gispkruidweg 52, 1313CV, Almere (business register/KvK: not yet registered, VAT: not yet issued). By creating an account or using the Service you agree to these terms. If operation is later transferred to a company owned by the same operator, the provider identity will be updated and you will be notified in the app; the Service and these terms otherwise continue unchanged.

1. Eligibility — the Service is 18+ only

You must be at least 18 years old — or older, where the age of majority in your country is higher — and able to enter a binding contract. This applies to the whole Service, not only to its adult content: no part of it is offered to minors.

To register you must give a truthful date of birth and your country of residence. We rely on both to comply with the law, so giving false information is a breach of these terms and we may suspend or close the account. Your date of birth cannot be changed by yourself once given; contact us if it needs correcting.

2. Regional availability

The Service is offered only in the countries we are able to serve lawfully, and that list may change. We determine where you are from your IP address and from the country of residence you declare, and we apply whichever is more restrictive (see the Privacy Notice for how this works and what we record).

If you are located in, or declare residence in, a country we do not serve, access is refused and you may not use the Service. Attempting to conceal or misrepresent your location — for example through a VPN, proxy, or a false declaration — in order to obtain access is a breach of these terms, and we may close the account.

3. Adult content by jurisdiction

Where adult ("18+") content is available at all, it is optional and off by default. Its availability depends on the law of your jurisdiction:

• in some countries it is not offered at all;
• in some countries your confirmed age and opt-in are sufficient;
• in some countries the law requires a certified age verification before it may be shown. In those countries adult content stays unavailable until such a verification is offered and you complete it (see the Privacy Notice, §3) — it proves only that you are over 18 and discloses no other information to us. A verification is valid for 12 months.

We may change what is available in a given country at any time, including with immediate effect, if the law there changes.

4. Beta service — read this before relying on the Service

The Service is offered as a beta: it is provided "as is" and "as available", features change, and interruptions or degraded quality can occur without notice. In particular you acknowledge that stories, sessions, generated media, characters and other content may be lost, reset or become unavailable during the beta — keep your own copies of anything you want to preserve (Settings → My data exports everything). We work carefully, but a beta is not a finished product, and accepting these terms includes accepting that.

5. Your account

Keep your credentials secure; you are responsible for activity under your account. Provide accurate information. We may suspend or close accounts that breach these terms or the Acceptable Use Policy.

6. The Service

ProjectDigo lets you generate AI images and videos and play AI-driven roleplay stories. Output is generated by AI and may be inaccurate, imperfect, or not to your expectation; it is provided "as is". Generated media is marked as AI-generated (see the AI Transparency Statement).

7. Acceptable use and reporting

You must follow the Acceptable Use Policy. In short: no illegal content, no content that sexualises minors, no real-person deepfakes intended to deceive or harm, no infringement of others' rights, no attempts to break or abuse the Service.

If you encounter content created by another user that you believe is illegal or violates the rules, report it in the app (the report action on the content) or by email to info@projectdigo.com. You receive a confirmation, a decision, and the reasons for it (see the Content Reporting page).

8. Your content and rights

You retain your rights in the prompts you write and, subject to applicable law and the capabilities of the underlying AI models, in the output you generate for your own use. You grant us the limited rights needed to operate the Service (store, process, and display your content back to you, and transmit prompts to our AI provider to produce results). You are responsible for ensuring your prompts and any images you upload do not infringe others' rights.

9. Tokens and payments

During the free beta no purchases are offered and no payments are accepted. Any tokens or credits on your account in this period are promotional, free of charge, carry no monetary value, cannot be bought, refunded or transferred, and may be adjusted, expired or reset as part of beta operation.

If and when paid features open, prices, the token system and the applicable terms — including the EU consumer right of withdrawal and its digital-content mechanics (immediate supply with your express consent and acknowledgment that the withdrawal right is then lost) — will be shown clearly before any purchase, and invoices will be issued. Payments will be introduced only together with the required business registration.

10. Availability and changes

We may change, suspend, or discontinue parts of the Service, and may update these terms. Material changes will be notified and may require renewed acceptance.

11. Liability

The Service is a free beta entertainment product. To the maximum extent permitted by law: the Service is provided without warranties; we are not liable for indirect or consequential damage, loss of data (see §4), or loss of profits; and our total liability for all claims in any 12-month period is limited to the amount you paid us in that period (during the free beta: zero) or, where a mandatory rule requires a minimum, EUR 50. Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or any other liability that cannot be limited by law, and nothing limits the mandatory consumer protections of your country of residence.

12. Termination

You may close your account at any time (Settings → My data). We may terminate for breach. Provisions that by nature survive termination (e.g. accounting, liability) continue.

13. Governing law

These terms are governed by the law of the Netherlands; the competent courts of the Netherlands have jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
